By President’s Decree, an Interim
Supreme Court is formed

Presidential Palace, Kabul - The following
Presidential Decree was signed on 3 January 2005 by the President
of the Islamic Republic of Afghanistan:
DECREE OF
THE PRESIDENT OF THE ISLAMIC REPUBLIC OF AFGHANISTAN
ON FORMATION OF THE INTERIM SUPREME COURT AND APPOINTMENT OF
ITS
MEMBERS
No. 13, Dated 14 Jaddi 1383
Article 1: As per the third paragraph of Article
160 of the Constitution, the Interim Supreme Court is formed
by this decree.
Article 2: Appointment of the chairman and members
of the Interim Supreme Court is approved as below:
1. Esteemed Fazl Hadi Shinwari as chief justice
and chairman of the Supreme Court
2. Mawlawi Fazl Wahab as member of the Supreme Court
3. Mawlawi Qiamoddin Kashaf as member of the Supreme Court
4. Mawlawi Sayed Omar Monib as member of the Supreme Court
5. Mawlawi Abdorrazaq Mosamem as member of the Supreme Court
6. Mawlawi Samar Gol Ashraf as member of the Supreme Court
7. Mawlawi Morad Ali Morad as member of the Supreme Court
8. Mawlawi Mohammad Azim Jalili as member of the Supreme Court
9. Mawlawi Mohammad Hashem Salehi as member of the Supreme Court
Article 3: The chairman and members of the Interim
Supreme Court, as mentioned in the second of this decree, should
continue their jobs until the Supreme Court is formed based
on the second paragraph of Article 161 and according to the
provisions of Article 117 and Article 118 of the Constitution.
Article 4: Military judges working within the
structure of the Supreme Court should be discharged and introduced
to the National Defence Ministry within 30 days after the announcement
of this decree.
Article 5: This decree comes into force from 14
Jaddi 1383 (3 January 2005) and should be published in the official
gazette.
